This Privacy Policy describes how eleectra.com (the “Site”, the “App”, “we”, “us” or “our”) collects, uses, and discloses your Personal Information when you visit, use our services, or make a purchase from the Site or the App.
For the purposes of the General Data Protection Regulation (“GDPR”) and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”), the data controller is eleectra.com, established in Spain.
Collecting Personal Information
When you visit the Site or use the App, we collect certain information about your device, your interaction with the Site/App, and information necessary to process your purchases or provide you with our services. We may also collect additional information if you contact us for customer support.
In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information.” See the list below for more information about what Personal Information we collect and why.
Device information
Examples of Personal Information collected: version of web browser, IP address, time zone, cookie information, unique device identifiers, what pages, sites or products you view, search terms, and how you interact with the Site or App.
Purpose of collection: to load the Site/App accurately for you, to maintain the security of our services, and to perform analytics on usage in order to optimize and improve our Site, App, and services.
Source of collection: collected automatically when you access our Site or App using cookies, log files, web beacons, tags, pixels, local storage, and similar tracking technologies.
Disclosure for a business purpose: shared with our processor Shopify, as well as with analytics and hosting providers (such as Google Analytics and our web hosting provider) strictly for the purposes described above.
Order information
Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, debit card details, PayPal, Apple Pay, Google Pay and other payment methods that may be made available), email address, and phone number.
Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping or delivery, provide you with invoices and/or order confirmations, communicate with you about your order, screen our orders for potential risk or fraud, and, when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
Source of collection: collected directly from you.
Disclosure for a business purpose: shared with our processor Shopify, payment gateways (such as Stripe, PayPal, and similar providers), shipping and logistics providers, invoicing and accounting tools, and other service providers that help us fulfill orders and manage our relationship with you.
Customer support information
Examples of Personal Information collected: contact details (name, email address, phone number), details of your requests, messages or complaints, order or account information, technical information related to the incident (such as device data and error logs), and any other information that you choose to provide when you contact us.
Purpose of collection: to provide customer support, manage and respond to your requests, improve our services, and keep a record of communications for quality and training purposes.
Source of collection: collected directly from you when you contact us via email, contact forms, in-app messages, or other support channels.
Disclosure for a business purpose: shared with third-party customer support and communication tools (such as email providers, ticketing systems and live-chat providers), and, where necessary, with technical service providers assisting us in diagnosing and resolving issues.
Other information we may collect
Account data: login credentials (hashed), account settings and preferences.
Communication and marketing data: your subscription preferences, marketing consent, and records of your interaction with our newsletters or campaigns.
Offline data: information you provide at events, over the phone, or through offline forms, which is then input into our systems.
No purchased marketing lists: we do not buy third-party marketing lists or sell your Personal Information.
Minors
The Site and App are not intended for individuals under the age of 14. In accordance with Spanish data protection law (LOPDGDD), minors under 14 years of age cannot give valid consent to online services without the authorization of their parents or legal guardians.
We do not knowingly collect Personal Information from children under 14. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us at ecmssuport@gmail.com to request deletion.
Sharing Personal Information
We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

We require all third-party service providers to respect the security of your Personal Information and to process it in accordance with applicable data protection law and our instructions.
Behavioural Advertising
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.

Using Personal Information

Lawful Basis (EEA and Spain)
Pursuant to the General Data Protection Regulation (“GDPR”) and Spanish Organic Law 3/2018 (“LOPDGDD”), if you are a resident of the European Economic Area (“EEA”) or Spain, we process your Personal Information under one or more of the following lawful bases:

The performance of a contract between you and the Site/App.
Compliance with our legal obligations.
Protection of your vital interests.
Performance of a task carried out in the public interest.

Retention
When you place an order through the Site or use our services, we will retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected, including any legal, accounting, or reporting requirements.
In particular:
Order and billing data may be retained for the periods required by Spanish tax and commercial law.
User account data will be retained while your account is active and, thereafter, for the time necessary to address potential liabilities.
You may request the erasure of your Personal Information as described in the “Your Rights” section below. In some cases, we may be legally required or permitted to retain certain data despite your request (for example, to comply with legal obligations or to defend legal claims).
Automatic Decision-Making
If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (including profiling) when that decision-making has a legal effect on you or otherwise significantly affects you.
We do not engage in fully automated decision-making that has a legal or otherwise significant effect on you using customer data.
Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:
Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.
Selling Personal Information
Our Site does not sell Personal Information, as defined by the California Consumer Privacy Act of 2018 (“CCPA”). We do not sell the Personal Information of minors under 16 and we do not offer any financial incentives related to the sale of Personal Information.
If this were to change in the future, we would update this Privacy Policy and provide you with all relevant information and opt-out options as required by applicable law.
Your Rights
GDPR / LOPDGDD (EEA & Spain)
If you are a resident of the EEA or Spain, you have the following rights under the GDPR and Spanish data protection law:
Right of access: to obtain confirmation of whether we process your Personal Information and, if so, to receive a copy.
Right to rectification: to request correction of inaccurate or incomplete Personal Information.
Right to erasure (“right to be forgotten”): to request the deletion of your Personal Information in certain circumstances.
Right to restriction of processing: to request that we limit the processing of your Personal Information in certain cases.
Right to data portability: to receive your Personal Information in a structured, commonly used and machine-readable format, and to transmit it to another controller where technically feasible.

Right to withdraw consent: where processing is based on consent, you may withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

At the date of this Privacy Policy, our services are primarily directed to users in Spain and the EEA, and we do not meet the applicability thresholds of the CCPA.
